Case Studies: Computer Forensics
When a judge ordered an independent review of computer systems to settle a dispute
concerning the existence and authenticity of computer generated financial documents,
Rachlin Computer Forensics was called into action. Our team was instructed to perform
a review of the computer systems in question and report its findings back to the court.
In a matter of days, our experts were able to determine that the party in possession of the
computer had entered the accounting system and purposefully deleted and/or modified the items
subject to the scope of the review. Further, the computer had been tampered with and "scrubbed"
to cover any traces of such activity following the court order directing the review.
In response to our expert witness testimony, the party in possession of the computers admitted to
scrubbing the systems as well as modifying the systems for the purpose of misleading the court.
The judge drew a negative inference and ordered sanctions, including attorney fees and costs.
